Article I: Preamble and Purposes
Section 1
Whereas it is the mutual objective of the Board of Education of the School District of the City of St.
Charles and of the St. Charles Education Support Staff Association to provide the best education
possible within the limits of available resources for the students of the public schools of the District,
and,
Section 2
Whereas it is desirable to work toward understanding, cooperation and shared responsibility between
the Board of Education and the support staff of the District, and,
Section 3
Whereas the guarantee of a free and open exchange of views is necessary to ensure efficient,
uninterrupted and strife-free operation of the public schools of the District,
Section 4
Now, therefore, the Board of Education of the School District of the City of St. Charles and the St.
Charles Education Support Staff Association hereby agree that the following Articles of GDQD
represent the full and complete understanding and commitment between the parties. Pursuant to the
above, this policy (GDQD) shall not be altered in any manner except through the two successive
Board meeting process established by the Board of Education.
Article II: Definitions
Section 1
The term "support staff" shall refer to all regularly employed personnel except administrators and
teachers.
Section 2
The term "Teams" shall mean the representatives of the Board and the Association.
Section 3
The term "Agreement" shall refer to Board policy GDQD.
Section 4
The term "Days" shall mean calendar days except where otherwise provided. In reference to
deadlines cited in this Agreement and Board policies, the day of occurrence will not be counted as
the first day. The last day will be included and will end at five o'clock in the afternoon (5:00 p.m.).
Article III: Board Rights and Duties
The Board retains and reserves unto itself all powers, rights, authority, duties and responsibilities
conferred upon and vested in it by the statutes of the State of Missouri, and nothing in this
Agreement shall be construed to limit the Board in the exercise of its regular and customary
functions and operation of the District.
Article IV: Recognition
Section 1: Exclusive Representative
The Board of the School District of the City of St. Charles, hereinafter referred to as "Board" hereby
recognizes the St. Charles Support Staff Education Association, affiliated with the Missouri-NEA
and the National Education Association, hereinafter referred to as "Association," as the exclusive
representative for all regularly employed library assistants, special education paraprofessionals,
computer lab assistants, nurses, health clerks, building secretaries, audio visual and printing
technician, audio visual and printing secretary, vocational-technical adult education and distribution
secretary, assessment center secretary, audio visual building supervisor, general maintenance,
custodians, school district cafeteria employees, central office secretaries (not excluded), and central
office bookkeeper (not excluded) personnel of the District.
Section 2: Individual Rights
Nothing in this Agreement shall be construed as to preclude the appearance of any support staff on
his or her own behalf before the Board when it is meeting in official session, in accordance with the
established policy for such appearance, or to preclude the adjustment of any problem raised with
regard to such support staff in a manner agreeable to the Board and the support staff as long as such
adjustment is not in violation of this Agreement, and provided that this Section shall not deprive the
Board of its right to interpret Board policy.
Article V: Scope
Section I: Areas of Discussion
The following items shall be considered proper items for discussion by the teams:
Goals and objectives (including equal opportunity employment), professional development
opportunities, complaints and grievances (including staff protection), staff-student relations
(including participation in community activities and public appearances), gifts by and to staff
members, personnel records, salary deductions, compensation guides and contracts (including merit
system), orientation, evaluation, suspension (including unrequested leave), transfer, separation,
registration, re-employment, retirement, calendar, work schedules, nonschool employment (such as
consulting or tutoring for pay), professional organizations, professional leaves and absences and
personal leaves and absences (such as emergency, legal, illness, maternity, military or bereavement).
Section 2
The Board may, at its discretion, authorize the discussion of other items.
Article VI: Procedure
Section 1: Teams
Each Team shall not exceed eight (8) persons at any session. Team members shall be restricted to
only district employees and Board members. Neither Team will be permitted to bring observers to
any session, unless approved by the Board.
Section 2: Presentation of Proposal
A presentation will be made no later than the Wednesday after the January Board meeting, by the
superintendent or designee, to both Teams so that there is a common basis for discussions on
anticipated revenue and expenditures for the year(s) being discussed. Written proposals must be
exchanged at this first meeting and dates will be set for future meetings.
Section 3: Good Faith Discussions
The Board agrees to participate in good faith discussion with the duly authorized representatives of
the Association. Both parties agree that it is their responsibility to meet at reasonable times to
discuss in good faith and make fair and honest exchanges of proposals.
Section 4: Meeting Dates and Times
The meeting dates and times shall be annually determined at the regular September Board meeting.
Section 5: Discussions
Both Teams shall make proposals, consider proposals and counterproposals and attempt to reach
tentative agreements.
Tentative agreements shall be set down in writing and presented to the Board for consideration and
approval, and to the Association for ratification. Discussions will end on March 15.
Section 6: Memorandum of Understanding
Items of agreement will be jointly submitted as the Memorandum of Understanding to the Board for
its approval.
Any items unresolved during the sessions may be submitted to the Board as impasse items at the end
of March.
Section 7: Publication of Agreement
Copies of the GDQD and pertinent GA, GB and GD policies will be printed at the expense of the
Board within 30 days after the Agreement is approved by the Board and reviewed by the MSBA
Policy Services. Ten (10) copies shall be placed in each school with an additional 25 copies
furnished to the Association for its use.
Article VII: Legal Status
If any Article, Section, clause or provision of this document be in conflict with Constitution or laws
of the United States of America, or with the Constitution or laws of the State of Missouri, or with
the rules and regulations of any duly constituted regulatory agency of the United States of America
or the State of Missouri, or with any decision of any court of competent jurisdiction, then that
Article, Section, clause or provision shall be null and void but all remaining Articles, Sections,
clauses and provisions shall remain in full force and effect until modified under the provisions
herein. The parties agree to meet and discuss only items which would be found in contradiction of
any such law and attempt to reach agreement on successor language within a period of two (2) weeks
from the date of learning of any adverse ruling or law.
